Their entry may be defined as illegal if movement takes part outside of the receiving country\u2019s normal procedures (for example, if they travelled through a safe country to the ultimate receiving country).<\/p>\n\n\n\n<p style=\"font-size:15px\">This entry does not discuss human trafficking (see <a href=\"https:\/\/www.safeseas.net\/evidence\/2020\/02\/10\/human-trafficking\/\">Human Trafficking<\/a>). While transportation methods, practices, and actors may be the same in some cases, there are recognised differences in the way perpetrators and victims are viewed and treated.<span id='easy-footnote-4-37' class='easy-footnote-margin-adjust'><\/span><span class='easy-footnote'><a href='https:\/\/www.safeseas.net\/evidence\/2020\/02\/10\/human-smuggling\/#easy-footnote-bottom-4-37' title='&lt;a href=&quot;https:\/\/www.embraceni.org\/wp-content\/uploads\/2006\/06\/Distinguishing%5B1%5D1.pdf&quot;&gt;Iselin &amp;amp; Adams 2003&lt;\/a&gt;'><sup>4<\/sup><\/a><\/span> It is important to note that people smuggling can become human trafficking if those being smuggled are victims of exploitative acts such as withdrawal of passport or debt bondage etc..<\/p>\n\n\n\n<p style=\"font-size:15px\">The crossing of maritime boundaries by sea can occur in any type of vessel, though often takes place in small boats with migrants disembarking at unofficial border points such as beaches or jetties. Stateless people may migrate for economic reasons, but also for reasons of kinship and cultural affinity. Various international bodies are involved in counter-people smuggling responses, including the UN Office on Drugs and Crime (UNODC) and IOM. The IOM, for example, has an Immigration and Border Management (IBM) Division, that \u2018assists Member States to build and strengthen their capacities to directly intervene in and disrupt migrant smuggling operations, requiring coordination with legislative bodies, implementing effective border control measures and ensuring the concerted action of law enforcement agencies\u2019.<span id='easy-footnote-72-37' class='easy-footnote-margin-adjust'><\/span><span class='easy-footnote'><a href='https:\/\/www.safeseas.net\/evidence\/2020\/02\/10\/human-smuggling\/#easy-footnote-bottom-72-37' title='&lt;a href=&quot;https:\/\/www.iom.int\/sites\/default\/files\/our_work\/DMM\/IBM\/IOM-Approach-to-counter-migrant-smuggling-Brochure.pdf&quot;&gt;IOM&lt;\/a&gt; &lt;a href=&quot;https:\/\/www.iom.int\/sites\/default\/files\/our_work\/DMM\/IBM\/IOM-Approach-to-counter-migrant-smuggling-Brochure.pdf&quot;&gt;2016&lt;\/a&gt;'><sup>72<\/sup><\/a><\/span> A UN Network on Migration has been  established that structures ongoing cooperation between these bodies.<span id='easy-footnote-73-37' class='easy-footnote-margin-adjust'><\/span><span class='easy-footnote'><a href='https:\/\/www.safeseas.net\/evidence\/2020\/02\/10\/human-smuggling\/#easy-footnote-bottom-73-37' title='&lt;a href=&quot;https:\/\/migrationnetwork.un.org\/&quot;&gt;Migration Network n.d.&lt;\/a&gt;'><sup>73<\/sup><\/a><\/span><\/p>\n\n\n\n<p style=\"font-size:16px\">Regionally, the EU has perhaps the most comprehensive response to people smuggling. The EU adopted a specific EU action plan against migrant smuggling (2015-2020) in 2015,<span id='easy-footnote-74-37' class='easy-footnote-margin-adjust'><\/span><span class='easy-footnote'><a href='https:\/\/www.safeseas.net\/evidence\/2020\/02\/10\/human-smuggling\/#easy-footnote-bottom-74-37' title='&lt;a href=&quot;https:\/\/publications.parliament.uk\/pa\/ld201516\/ldselect\/ldeucom\/46\/4602.html&quot;&gt;European Union Committee 2015&lt;\/a&gt;'><sup>74<\/sup><\/a><\/span> and a renewed plan in 2020.<span id='easy-footnote-75-37' class='easy-footnote-margin-adjust'><\/span><span class='easy-footnote'><a href='https:\/\/www.safeseas.net\/evidence\/2020\/02\/10\/human-smuggling\/#easy-footnote-bottom-75-37' title='&lt;a href=&quot;https:\/\/home-affairs.ec.europa.eu\/renewed-eu-action-plan-against-migrant-smuggling-2021-2025-com-2021-591_en&quot;&gt;European Union Committee 2020&lt;\/a&gt;'><sup>75<\/sup><\/a><\/span> These action plans were envisaged in the European Agenda on Migration, which identified migrant smuggling as a priority.<span id='easy-footnote-76-37' class='easy-footnote-margin-adjust'><\/span><span class='easy-footnote'><a href='https:\/\/www.safeseas.net\/evidence\/2020\/02\/10\/human-smuggling\/#easy-footnote-bottom-76-37' title='&lt;a href=&quot;https:\/\/home-affairs.ec.europa.eu\/european-agenda-migration-press-material_en&quot;&gt;European Commission n.d.&lt;\/a&gt;'><sup>76<\/sup><\/a><\/span> The EU has established operational mechanisms such as the European Migrant Smuggling Centre, and Europol\u2019s Joint Operational Team Mare (an intelligence-led maritime centre dedicated to tackling migrant smugglers in the Mediterranean).<\/p>\n\n\n\n<div style=\"height:25px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p style=\"font-size:16px\"><em>National<\/em><\/p>\n\n\n\n<p style=\"font-size:16px\">For receiving countries, maritime responses have generally centred on detection and interdiction at sea. Countries employ monitoring such as patrols and aerial surveillance, both to interdict and deter migrant vessels but also to conduct search and rescue operations at sea.<span id='easy-footnote-77-37' class='easy-footnote-margin-adjust'><\/span><span class='easy-footnote'><a href='https:\/\/www.safeseas.net\/evidence\/2020\/02\/10\/human-smuggling\/#easy-footnote-bottom-77-37' title='&lt;a href=&quot;https:\/\/committees.parliament.uk\/writtenevidence\/43163\/html\/&quot;&gt;Edmunds &amp;amp; Edwards 2022&lt;\/a&gt;; &lt;a href=&quot;https:\/\/frontex.europa.eu\/documents-and-publications\/risk-analysis-for-2020-vp0TZ7&quot;&gt;Frontex 2020&lt;\/a&gt;; &lt;a href=&quot;https:\/\/journals.sagepub.com\/doi\/full\/10.1177\/0010836718780175&quot;&gt;Cusumano 2019&lt;\/a&gt;'><sup>77<\/sup><\/a><\/span> Migrant vessels may be boarded, with the irregular migrants arrested, or shadowed to the coast where land-based agencies make the arrest.<\/p>\n\n\n\n<p style=\"font-size:16px\">The deterrent effect of such tactics has been questioned given that many irregular migrants may actually want to be detained in a receiving country\u2019s waters so they are able to make it safely into that jurisdiction.<span id='easy-footnote-78-37' class='easy-footnote-margin-adjust'><\/span><span class='easy-footnote'><a href='https:\/\/www.safeseas.net\/evidence\/2020\/02\/10\/human-smuggling\/#easy-footnote-bottom-78-37' title='&lt;a href=&quot;https:\/\/committees.parliament.uk\/work\/6463\/operation-isotrope-the-use-of-the-military-to-counter-migrant-crossings\/publications\/&quot;&gt;UK Parliament Defence Committee 2022&lt;\/a&gt;'><sup>78<\/sup><\/a><\/span> A more controversial tactic has been to try and \u2018pushback\u2019 migrant vessels to prevent them from entering a receiving country\u2019s jurisdictional waters.<span id='easy-footnote-79-37' class='easy-footnote-margin-adjust'><\/span><span class='easy-footnote'><a href='https:\/\/www.safeseas.net\/evidence\/2020\/02\/10\/human-smuggling\/#easy-footnote-bottom-79-37' title='&lt;a href=&quot;https:\/\/sherloc.unodc.org\/cld\/bibliography\/2010\/injustice_ignored_a_case_study_of_the_irregular_sea_migration_of_the_rohingyan_boat_people.html&quot;&gt;Espinella 2010&lt;\/a&gt;'><sup>79<\/sup><\/a><\/span> Pushbacks have occurred in Thailand for example, where Rohingya refugee boats have been prevented from entering Thai waters.<span id='easy-footnote-80-37' class='easy-footnote-margin-adjust'><\/span><span class='easy-footnote'><a href='https:\/\/www.safeseas.net\/evidence\/2020\/02\/10\/human-smuggling\/#easy-footnote-bottom-80-37' title='&lt;a href=&quot;https:\/\/sherloc.unodc.org\/cld\/bibliography\/2010\/injustice_ignored_a_case_study_of_the_irregular_sea_migration_of_the_rohingyan_boat_people.html&quot;&gt;Espinella 2010&lt;\/a&gt;'><sup>80<\/sup><\/a><\/span> Pushback tactics can often be very dangerous due to the fragility of migrant vessels and the vulnerability of the people on board.<\/p>\n\n\n\n<p style=\"font-size:16px\">Other approaches aim to target the root causes of migrant smuggling. These aim to focus on &#8216;pull&#8217; rather than &#8216;push&#8217; factors of economic disparity. Addressing pull factors may include criminal investigation into the smuggling networks that facilitate the movement of people. There is a risk, however, of targeting perpetrators who themselves are vulnerable, as is the case of Indonesian fishermen who smuggle people on behalf of others.<span id='easy-footnote-81-37' class='easy-footnote-margin-adjust'><\/span><span class='easy-footnote'><a href='https:\/\/www.safeseas.net\/evidence\/2020\/02\/10\/human-smuggling\/#easy-footnote-bottom-81-37' title='&lt;a href=&quot;https:\/\/journals.sagepub.com\/doi\/abs\/10.1350\/jcla.2012.76.6.806&quot;&gt;Bagaric 2021&lt;\/a&gt;; &lt;a href=&quot;https:\/\/link.springer.com\/chapter\/10.1057\/9781137008695_22?noAccess=true&quot;&gt;Grewcock 2009&lt;\/a&gt;'><sup>81<\/sup><\/a><\/span> Another response is the establishment of offshore processing centres that mean migrants are not able to access the country while awaiting the outcome of their immigration or asylum hearing. Australia has established processing centres in the Pacific Islands for example, and the UK has put forward a plan to do similar in Rwanda.<\/p>\n\n\n\n<p style=\"font-size:16px\">Such tactics have been criticised on &nbsp;humanitarian grounds and there have been allegations of abuse occurring at some locations.<span id='easy-footnote-82-37' class='easy-footnote-margin-adjust'><\/span><span class='easy-footnote'><a href='https:\/\/www.safeseas.net\/evidence\/2020\/02\/10\/human-smuggling\/#easy-footnote-bottom-82-37' title='&lt;a href=&quot;https:\/\/www.amnesty.org\/en\/documents\/asa12\/002\/2013\/en\/&quot;&gt;Amnesty International 2013&lt;\/a&gt;'><sup>82<\/sup><\/a><\/span> It has also been suggested that easier access to legitimate migration and asylum routes will stop the need to turn to illicit channels and will deprive smugglers of their profits.<span id='easy-footnote-83-37' class='easy-footnote-margin-adjust'><\/span><span class='easy-footnote'><a href='https:\/\/www.safeseas.net\/evidence\/2020\/02\/10\/human-smuggling\/#easy-footnote-bottom-83-37' title='&lt;a href=&quot;https:\/\/econpapers.repec.org\/paper\/izaizadps\/dp1025.htm&quot;&gt;Friebel &amp;amp; Guriev 2004&lt;\/a&gt;'><sup>83<\/sup><\/a><\/span> This can be seen in the UK context, where people smuggling grew rapidly after the country\u2019s refugee resettlement scheme was suspended during the COVID-19 pandemic.
